This User Agreement (“Agreement”) is an agreement between you and NerdBeing (“we”, “our”, or “us”) governing your use of the NerdBeing website and the NerdBeing mobile application on iOS and Android (together, the “App”, “Service”, or “Services”).

By accessing or using the Service, you agree to be bound by this Agreement and our Privacy Policy. If you do not agree, please do not use the Service. NerdBeing will not be liable for any consequences arising from your unauthorized use.

The Service

NerdBeing is a technical interview preparation app for software engineers. It helps you practice engineering concepts, test what you know, find weak areas, and learn from explanations. The website describes the App. Downloading the App is handled by the App Store or Google Play, and those stores’ terms apply to the download and any purchase.

Practice questions and explanations are for preparation. They are not a promise of an interview result, a job, a score, or a certification. NerdBeing is not a university, an employer, or an interview provider.

Access to the Service is permitted on a temporary basis. We may withdraw, suspend, or modify the App or any of its features at any time, with or without prior notice. We shall not be liable if, for any reason, the Service is unavailable at any time or for any duration.

Changes to these Terms

We may revise these Terms at any time by updating this page. Changes are effective when posted. If a change may materially affect your use of the Service, we will use reasonable efforts to notify you, such as in the App or by email. Your continued use of the Service after changes become effective is acceptance of the updated Terms. If you do not agree, you must stop using the Service and may delete your account.

Eligibility and accounts

To create an account you must be at least 18 years old and legally able to accept these Terms. You must provide accurate and complete information, keep it up to date, and use the Service only in compliance with this Agreement and applicable law.

You are responsible for keeping your login details confidential and for activity on your account. Do not share your password or one-time codes. If you suspect unauthorized access, notify us immediately at nerdbeing@twoindianmonk.com. We are not liable for loss arising from your failure to keep the account secure.

You may not assign, transfer, or sell your account, or use automated tools, bots, or scripts to create accounts or access the Service in an unauthorized way.

License

Subject to these Terms, NerdBeing grants you a non-transferable, non-exclusive, non-sublicensable, limited right to access and use the Service for personal, non-commercial interview preparation.

You agree not to:

• Copy, reproduce, distribute, sell, or share any part of the Service without our written authorization
• Alter, modify, or create derivative works from the Service except as needed for your personal use of the App
• Decompile, reverse engineer, or attempt to extract source code, except as permitted by law
• Remove proprietary notices
• Use scrapers, bots, or other automated means to extract questions, explanations, or other content
• Interfere with security, overload the Service, or disrupt other users

All intellectual property rights in the App, website, design, text, graphics, questions, explanations, software, and related materials (excluding your own account data) are owned by NerdBeing or its licensors. Nothing in these Terms grants you ownership of that material.

Your content

You are responsible for information you submit, including profile details, practice answers, and messages you send us. You represent that you have the right to provide that information and that it does not infringe anyone else’s rights or violate applicable law.

By using the Service you grant NerdBeing a limited, non-exclusive, royalty-free, revocable license to host, store, process, and display that information solely to operate and improve the Service. You retain ownership of your personal data and practice history.

If you send feedback or suggestions, we may use them without obligation to compensate you.

Acceptable use

You must not use the Service to:

• Impersonate another person or create a false identity
• Upload unlawful, harmful, or infringing material
• Introduce viruses, malware, or other harmful code
• Attempt unauthorized access to the App, servers, or other accounts
• Share paid or copyrighted question content outside the App in a way that violates these Terms

We may remove content, suspend, or terminate accounts that violate this Agreement or the Privacy Policy, with or without notice. Upon termination, licenses granted to you end, and you may lose access to stored progress.

Plans, billing, and cancellation

The App may include a free plan and paid features. Prices, plan limits, and billing periods are shown in the App Store, Google Play, or the App at the time of purchase.

If you purchase through Apple or Google, billing, renewal, and cancellation follow that store’s policies. Subscriptions typically renew unless cancelled at least 24 hours before the end of the current period. Refunds, where available, must be requested through the relevant store. NerdBeing may not be able to process those refunds itself.

We may change plans or pricing. If a change materially affects a paid subscription, we will make reasonable efforts to provide notice. Continued use after the change takes effect is acceptance. If you do not agree, cancel before the next billing cycle.

To the extent permitted by law, payments are non-refundable except where the store or applicable consumer law requires otherwise. Nothing in these Terms overrides mandatory consumer rights in your jurisdiction.

You are responsible for any taxes that apply to your purchase. If you claim a tax exemption, you must provide valid documentation where required.

Privacy

Our Privacy Policy explains how NerdBeing collects, uses, and protects your personal data, including name, email, practice progress, and device information. By using the Service you consent to that processing as described there, in line with applicable law including the GDPR and India’s Digital Personal Data Protection Act, 2023.

Disclaimers

Your use of the Service is at your own risk. The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will meet your interview, career, or learning expectations
• The Service will be uninterrupted, timely, secure, or error-free
• Practice results, explanations, or insights will be complete or free of mistakes
• Any particular error will be corrected immediately

Questions, explanations, and other content are for educational and preparation purposes. They do not replace your own judgment in an interview, at work, or in production systems.

Limitation of liability

You agree to defend, indemnify, and hold harmless NerdBeing, its directors, officers, employees, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of a third party’s rights.

To the maximum extent permitted by law, we exclude liability for indirect, incidental, special, punitive, or consequential damages, including loss of data, revenue, goodwill, or opportunity, even if foreseeable. Our total liability to you, if any, shall not exceed the amount you paid (if any) for access to paid NerdBeing features during the twelve (12) months before the claim. This does not limit rights that cannot be limited under applicable consumer law.

Third-party services

The Service may rely on or link to third parties, including Apple, Google, email delivery, and hosting providers. Your use of those services is also governed by their terms and privacy policies. We are not responsible for their availability, content, or practices, or for purchases handled by an app store.

Linking to the website

You may link to our homepage in a fair and legal way that does not damage our reputation or suggest endorsement where none exists. You must not frame the website. We may withdraw linking permission without notice.

Final terms

These Terms, together with the Privacy Policy, are the entire agreement between you and NerdBeing regarding the Service. If a provision is invalid, it will be limited to the minimum extent necessary, and the rest remains in effect. Our failure to enforce a provision is not a waiver. Nothing in these Terms creates a partnership, employment, or agency relationship.

These Terms are governed by the laws of India. The courts of Vadodara, Gujarat shall have exclusive jurisdiction over disputes arising from or related to your use of the Service.
